The President of the Republic of Kazakhstan has approved the country's new Digital Code.
The President of the Republic of Kazakhstan signed the Digital Code, a comprehensive regulatory document that establishes a unified legal framework for regulating digital technologies, data, and artificial intelligence. The Code aims to systematize existing legislation and transition from fragmented regulation to a cohesive digital legal system.
The document enshrines the concept of digital human rights. For the first time at the legislative level, citizens' rights to deletion, anonymization, and restriction of personal data processing have been defined, as well as the right to informed consent when using digital services. A separate provision allows for the review of decisions made using algorithms and automated systems with human involvement, which should enhance the transparency and accountability of AI-driven decisions.
The Digital Code regulates the use of digital documents and electronic confirmations, including one-time codes, push notifications, and other digital identification methods. It establishes the legal framework for the application of smart contracts, distributed information systems, and digital platforms, and defines the status of national digital objects and the procedures for their protection.
A separate block of norms is dedicated to data circulation. The Code enshrines principles for the exchange and use of digital data, creates legal conditions for launching a data circulation platform, and sets requirements for transparency of access and compliance with the rights of information owners. The document also strengthens requirements for ensuring cybersecurity and the resilience of digital infrastructure.
Furthermore, the Code includes provisions aimed at improving the accessibility of digital services for people with disabilities and low-mobility groups, as well as promoting the development of digital government services and the digital economy as a whole.
The adoption of the Digital Code is viewed as a key step in forming Kazakhstan's digital ecosystem and creating a legal basis for the implementation of modern technologies, including artificial intelligence, while simultaneously ensuring the protection of citizens' rights and business interests.
